This page contains the Terms and Conditions under which You may use any Web site owned by Applicant Tree (the "Web sites"), an online job board allowing:
  1. Employers to post jobs and search for qualified candidates.
  2. Job seekers to post confidential resumes, search for jobs, receive employer inquiries and accumulate cash each time an employer downloads their résumé, or that of their personal referrals.
Please read this page carefully. If You do not accept the Terms and Conditions stated here, do not use the Web sites and service. By using the Web sites, You are indicating your acceptance to be bound by the terms of these Terms and Conditions. Applicant Tree (the "Company"), the owner of the Web sites, may revise these Terms and Conditions at any time by updating this posting. You should visit this page periodically to review the Terms and Conditions, because they are binding on You. The terms "You" and "User" as used herein refer to all individuals and/or entities accessing this Web site for any reason.

Eligibility

Your must be at least 18, or the age of majority in your jurisdiction, whichever is older, to visit or use ApplicantTree.com. By visiting ApplicantTree.com or accepting these terms, You represent and warrant to Applicant Tree that You have reached the age of majority in your jurisdiction and that You have the right, authority and capacity to agree to and abide by these terms.

Use Of Material

Upon your purchase of a product offered by the Company, You are authorized to download a single copy of the material from the Company's Web sites solely for your own personal, noncommercial use.

The contents of the Web sites, such as text, graphics, images, logos, button icons, software and other content (the "Material"), are protected under United States and foreign copyright, trademark and other laws. All Material is the property of the Company or its content suppliers or clients. The compilation (i.e. the collection, arrangement and assembly) of all content on the Web sites is the exclusive property of the Company and protected by U.S. and international copyright laws. Unauthorized use of the Material may violate copyright, trademark and other laws. You must retain all copyright, trademark, service mark and other proprietary notices contained in the original Material on any copy (permitted or not permitted) You make of any of the Company's Material. You may not sell or modify the Company's Material or reproduce, display, publicly perform, distribute or otherwise use the Company's Material in any way for any public or commercial purpose. Further, the HTML code that is created by the Company while generating its pages is also protected by the Company's copyright.

The Company reserves the right to terminate the accounts of Users who violate the Company's policy on infringement of copyright or other intellectual property rights of others.

The Company and all of its affiliated companies respect the intellectual property of others, and we ask our Users and content partners to do the same. The unauthorized reproduction, copying, distribution, modification, public display or public performance of copyrighted works constitutes infringement of the copyright owner's rights. Applicant Tree reserves the right to alter the ads into the form of an e-mail to send to potential qualified candidates in our database. Such alterations will not affect any material information in regards to the position advertised.

User Contents And Submissions

You are solely responsible for your User account information, employer account information or job postings. You agree that in submitting User content or otherwise using any Applicant Tree site that you will not impersonate anyone, or submit any materials that are false, inaccurate, misleading, unlawful or otherwise in violation of your obligations under these terms.

By posting content to any public area of any Applicant Tree Web site, You automatically grant to Applicant Tree and its affiliates an irrevocable, royalty-free, perpetual, fully paid non-exclusive right and worldwide license to use, copy, reproduce, modify, adapt, publish, translate, communication to the public, perform display and distribute such content, in whole or in part, and to prepare derivative works of, or incorporate into other works (in any form) such User content, and to grant and authorize sublicenses thereof (through multiple tiers). You also represent and warrant that You have the right to grant or that the holder of any rights has completely and effectively waived all such rights and validly and irrevocably granted to You the right to grant the license stated above.

Applicant Tree acts as a passive conduit for the online distribution and publication of User content and has no obligation to screen User content, communications or information in advance and is not responsible for screening or monitoring User content posted by Users. However, Applicant Tree may review and remove any content that, in its sole judgment, violates these terms or applicable laws, or violates the rights of or harms/threatens the safety of any Applicant Tree Users. Applicant Tree may take any action with respect to User content that it deems necessary or appropriate in its sole discretion.

Applicant Resumes And Interviews

Each candidate made available through the Applicant Tree Web site has completed a résumé that includes specific questions regarding employment, education and more, and has also been personally interviewed. That said, the results of such interviews are not evaluated by Applicant tree and should be evaluated by each employer according to each employer's specific criteria. Resumes, profiles and/or interviews do not guarantee performance results or capture all criteria that may be relevant to an employer in making employment decisions. Applicant Tree does not independently verify the information provided by candidates or the identity of candidates.

Applicant Cash Earnings

After completing their profile on Applicant Tree, applicants are screened over the telephone to determine the value of their résumé, an amount ranging from $15 to $100. As soon as their basic work history, education and qualifications are complete, their résumé will go live and be searchable by employers. If an employer wishes to contact an applicant for an interview, the candidate résumé can be purchased and the applicant receives half of that amount. The more employers purchasing information, the more an applicant can earn.

Applicants also earn $5 each time they refer a new Applicant Tree member whose résumé is purchased by an employer.

Applicant Tree reserves the right to change the amount of, or basis for determining, any cash payments, and to institute a new payment structure without any prior notice.

Employer Fees And Payments

Applicant Tree may charge fees to Employers for services offered the Web site, and/or for access to portions of the Web site or the Web site as a whole. Employers agree to pay all fees and charges, including applicable taxes, incurred through their account at the rates in effect for the billing period in which such fees and charges are incurred, including but not limited to charges for any services offered for sale through the Web site by Applicant Tree (such fees, charges and taxes shall collectively be referred to as "Fees"). Applicant Tree reserves the right to change the amount of, or basis for determining, any Fees, and to institute new fees without any prior notice.

If You submit Your credit, debit or charge card information to Applicant Tree upon registration or otherwise, You give Applicant Tree permission to charge all fees incurred through your account to the credit, debit or charge card You designate. Any additional fees (other than normal usage fees) will be charged at the time they are incurred. If payment cannot be charged to Your credit, debit or charge card or Your payment is returned to Applicant Tree for any reason, including charge back, Applicant Tree reserves the right to either suspend or terminate Your account and all its obligations under this Agreement.

Refunds are handled on a case-by-case basis by the account executive assigned to each employer account. Refund requests must be made to the appropriate account executive within 30 days of the billing date, or the employer may forfeit any recompense.

Acceptable Site Use

Individuals seeking to find out more information or purchase the various products offered on the Web sites may use the Web sites only for lawful purposes.

Prohibited Uses of the Web Site



General Rules

Users may not use or reference the Company's Web sites in order to transmit, distribute, store or destroy material: (a) in violation of any applicable law or regulation; (b) in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others; (c) in a way that will violate the privacy, publicity or other personal rights of others; or, (c) that is defamatory, obscene, threatening, abusive or hateful.

Web Site Security Rules

Users are prohibited from violating or attempting to violate the security of the Web sites, including, without limitation: (a) accessing data not intended for such User or logging into a server or account which the User is not authorized to access; (b) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization; (c) attempting to interfere with service to any User, host or network, including, without limitation, via means of submitting a virus to the Web sites, overloading, "flooding," "spamming," "mailbombing" or "crashing"; (d) sending unsolicited e-mail, including promotions and/or advertising of products or services; or (e) forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting. The Company will investigate occurrences that may involve such violations and will cooperate with law enforcement authorities in prosecuting Users who are involved in such violations.

To help ensure a safe and effective experience for all our customers, Applicant Tree may limit the amount of data (including résumé views) that may be accessed by you in any given time period. These limits may be amended from time to time at Applicant Tree's sole discretion.

Furthermore, Users of the Web sites are prohibited from the following:
  • Using any device, software or routine to interfere or attempt to interfere with the proper working of the Web sites or any activity being conducted on the Web sites.
  • Taking any action that imposes an unreasonable or disproportionately large load on the Web site's infrastructure.
  • Notwithstanding anything to the contrary contained herein, using or attempting to use any engine, software, tool, agent or other device or mechanism (including, without limitation, browsers, spiders, robots, avatars and intelligent agents) to navigate or search the Web sites other than the search engine and search agents available from the Company on the Web sites as well as generally available third-party Web browsers, such as Netscape Navigator and Microsoft Internet Explorer.
  • Attempting to decipher, decompile, disassemble or reverse-engineer any of the software comprising or in any way making up a part of the Web sites.
  • Aggregating, coping or duplicating in any manner any of the materials or information available from the Web sites.
  • Framing of or linking to any of the materials or information available from the Web sites unless authorized to do so.
  • Providing false information of any kind.
The Company reserves the right to terminate the accounts of Users found to be engaging in any of these prohibited uses.

Specific Prohibited Uses

The job posting, résumé database (Applicant Tree Résumé Database) and other features of Applicant Tree may be used only for lawful purposes by individuals seeking employment and career information, and by employers seeking employees. Applicant Tree specifically prohibits any other use of ApplicantTree.com, including:
  • Posting any jobs on any Applicant Tree Web site for any competitor of Applicant Tree, or posting jobs or other content containing links to any site competitive with Applicant Tree.
  • Posting jobs or content on any Applicant Tree site that contain hyperlinks, "hidden" keywords or keywords that are irrelevant or misleading.
  • Using any Applicant Tree Résumé Database for any purpose other than as an employer seeking employees, including but not limited to, using the information to sell or promote any products or services.
  • Posting or submitting to ApplicantTree.com any incomplete, false or inaccurate biographical information or information that is not your own.
  • Sending unsolicited mail or e-mail, making unsolicited phone calls or sending unsolicited faxes regarding promotions and/or advertising of products and services to a User.
  • Deleting or revising any material posted by another person or entity.

User Information (Privacy Statement)
When you contact the Company, you may be asked to provide the Company with certain information including, without limitation, a valid e-mail address (your "Information"). Please review the Privacy Policy, the terms of which are incorporated here by reference, found on the Web sites to understand how the Company uses your information.

You understand and acknowledge that You have no ownership rights in your Applicant Tree account, and that if You cancel your account, all information from Applicant Tree will be marked as deleted in Applicant Tree's databases and will be removed from any public area of the Applicant Tree Web site. Information may be available for some period of time due to delays in propagating such deletion through Applicant Tree's Web servers. Additionally, third parties may retain cached copies of your information.

Applicant Tree's Liability
While the Company attempts to maintain the accuracy of the Web sites, the material may contain inaccuracies or typographical errors. The Company makes no representations about the accuracy, reliability, completeness or timeliness of the Web sites or the Material. The use of the Web site and the Material is at your own risk. Changes are periodically made to the Web sites and may be made at any time.

The Company does not render legal or financial advice. The Company specifically disclaims any liability, loss or risk incurred directly or indirectly by the use of the Web sites and services. If You need legal or financial advice, please contact qualified professionals in your area.

Applicant Tree is not involved with any decision-making or offers made from companies other than its own. Applicant Tree does not guarantee that your use of the Web sites will result in employment and/or recruitment.

Even though the Company monitors its Web sites and servers to help ensure that they are operating error-free and are free of computer viruses or other harmful mechanisms, the company does not warrant that the Web sites will at all times operate without error. If your use of the Web sites or Materials results in the need for servicing or replacing equipment or data, the company is not responsible for those costs.

The Company keeps its information as current as possible, but due to the nature of the Internet, it cannot guarantee that all URLs are currently working.

The Web sites and Materials are provided on an "as-is" basis without any warranties of any kind. The Company, to the fullest extent permitted by law, disclaims all warranties, whether express or implied, including the warranty of merchantability, fitness for a particular purpose and non-infringement. Applicant Tree is committed to fulfilling all legitimate employment requests by its employers, so the Company reserves the right to market a job through new and existing affiliate networks. Applicant Tree may establish an account with other job boards on behalf of the employer to promote a job posted by said employer through Applicant Tree. The Company will bear all responsibility, financial and otherwise, for any such account.

Disclaimer of Consequential Damages
In no event shall the company, its suppliers or any third parties mentioned on the Web sites be liable for any damages whatsoever (including, without limitation, incidental and consequential damages, lost profits or damage resulting from lost data or business interruption) resulting from the use or inability to use the Web sites and Materials, whether based on warranty, contract, tort or any other legal theory, and whether or not the Company is advised of the possibility of such damages.

Indemnity
You agree to defend, indemnify and hold harmless the Company, its officers, directors, employees and agents, from and against any claims, actions or demands, including, without limitation, reasonable legal and accounting fees resulting from your use of the Materials or your breach of the terms of these Terms and Conditions. The Company shall provide notice to You promptly of any such claim, suit or proceeding and shall assist You, at your expense, in defending any such claim, suit or proceeding.

Reserved Right of Refusal
The Company, in its sole discretion, reserves the right to refuse fulfillment of your order, or refuse You any involvement with Applicant Tree services, or to delete your assigned User name and password if You breach any of the terms of this Agreement.

Modifications to Agreement
Except as otherwise provided in this Agreement, You agree, during the term of this Agreement, that the Company may: (1) revise the terms and conditions of this Agreement; and/or (2) change part of the services, including employer fees or applicant payments, provided under this Agreement at any time. Any such revision or change will be binding and effective immediately after posting of the revised Agreement or change to the service(s) on the Company's Web sites. You agree to periodically review our Web sites, including the current version of this Agreement available on our Web sites, to be aware of any such revisions. Any fees paid by You if You terminate your Agreement with the Company are nonrefundable. By continuing to use the Company's services after any revision to this Agreement or change in services, including employer fees or applicant payments, You agree to abide by and be bound by any such revisions or changes. The Company is not bound by nor should You rely on any representation by (i) any agent, representative or employee of any third party that You may use to apply for our services; or (ii) information posted on our Web sites of a general informational nature. No employee, contractor, agent or representative of the Company is authorized to alter or amend the terms and conditions of this Agreement.

General Terms
The Company makes no claims that the Materials may be lawfully viewed or downloaded in your jurisdiction. Access to the Materials may not be legal by certain persons or in certain countries. If You access these Web sites, You do so at your own risk and are responsible for compliance with the laws of your jurisdiction. The internal substantive laws of the State of Florida govern these Terms and Conditions. Jurisdiction for any claims arising under this agreement shall lie exclusively with the courts within Orange County, and all parties submit to the jurisdiction of the venue of these courts.
